Administrative Matters

Members must be afforded an opportunity to respond to adverse material before a decision is made regarding their ongoing service. A member’s response can be powerful and can have a significant impact on an outcome. This may include the Australian Defence Force reaching a decision no action is required, effectively ceasing administrative action against a member.

Decision makers in the Australian Defence Force must be open to persuasion. They cannot approach a decision with a closed mind or a predetermined outcome. We assist members when it is most needed by providing responses to administrative actions, which include:

  • Notice to Show Cause: Formal warning;
  • Notice to Show Cause: Censure;
  • Notice to Show Cause: Termination; and
  • Notice to Show Cause: Positive Test Result;
  • Redress of Grievance;
  • Response to Fact Finds;
  • Complaints seeking compensation due to Defective Administration;
  • Office of the Inspector-General of the Australian Defence Force adverse findings; and
  • Complaints to the Commonwealth Ombudsman and Inspector-General: Australian Defence Force.

Should the Australian Defence Force provide an adverse finding following a response with respect to each of the above administration actions, it may be possible to seek review through a Redress of Grievance. Should you be, or have already been, subject to an adverse finding, please contact Soldier’s Legal Counsel to discuss how we can assist.
